Here are definitions of Will related terms An ADMINISTRATOR is some who is appointed by law to settle your affair if you die without leaving a will, or if the named Executor does not wish to act. An ATTORNEY is someone who is legally authorised in a Will to act on behalf of the deceased. A BENEFICIARY is someone who is left a legacy in your will. A CODICIL is a change or addition which you can make to your will. An ESTATE is the assets - property, possessions and money that you leave behind when you die. An EXECUTOR is someone you appoint in your will to see that your wishes and instructions are carried out after your death. INTESTACY is the name for the situation which arises when someone dies without making a will. A LEGACY is a gift left in a will. There are three common types of legacies A specific legacy which is a definite property or object. A pecuniary legacy which is a gift of a specific sum of money. A residuary legacy which is a gift of the money or assets left over when other legacies and expenses have been paid. PROBATE is the legal procedure to establish whether you left a valid will. If not, an Administrator is appointed. A TESTATOR ( or TESTATRIX is the female ) is a person who has made a will. A TRUSTEE a person or company appointed by a Will to manage the deceased 's Estate. A TRUST is an arrangement you can make in your will to administer part of your assets after your death, e.g. on behalf of your children if they are still minors.
